Terms of use

These terms apply when you use The Vine (thevinelist.com.au), which is run by The Vine List (ABN 89 731 970 117), owned by James Ghossein and Rachael Mackey. By using the site or creating an account, you agree to them. Please also read our privacy policy.

Who can use The Vine

The Vine is about alcohol, so you must be 18 or over to create an account. By creating one, you confirm that you are. The Vine is an information and community site. We don't sell alcohol.

Your account

• Give accurate details, and keep your password to yourself. You're responsible for what's done with your account.
• One account per person. Winery accounts are for staff of the winery they represent.
• Tell us straight away at [email protected] if you think someone else has used your account.

Reviews and other content you add

You keep ownership of the reviews, lists and other content you add. You give us permission to show it on The Vine, and to keep showing reviews and public lists for as long as your account exists. When you post content, you agree that:

• Your reviews are your honest opinion of wines you've actually tasted.
• You won't review your own winery's wines, or a competitor's, or post reviews you've been paid or rewarded for.
• You won't post anything unlawful, defamatory, abusive, hateful or misleading, anything that infringes someone else's rights, or any spam or advertising.

We may remove content that breaks these rules, and suspend or close accounts that break them, or that misuse the site in other ways.

Wine information

Our wine details come from many sources, including producers, public information and our members. We work to keep them accurate, but they can contain mistakes or go out of date. Prices shown are a guide only, not offers to sell. Community scores are our members' opinions. If you spot something wrong, please use the suggestion links on the site to let us know. Please drink responsibly.

Premium

• Premium is a paid subscription, billed monthly or yearly through Stripe. The current price is shown on the Premium page before you pay.
• New members may get a free trial. You won't be charged if you cancel before it ends. The trial is available once per member.
• Your subscription renews automatically at the end of each billing period until you cancel it. You can cancel any time from your profile. You'll keep Premium until the end of the period you've paid for.
• We don't give refunds for part of a billing period, except where the law requires one.
• If we change the price, we'll tell you by email before your next renewal, and the new price applies from that renewal.

Your rights under Australian law

Our services come with guarantees that can't be excluded under the Australian Consumer Law. Nothing in these terms limits those rights.

Our responsibility

We provide The Vine as it is, and we can't promise it will always be available or free of errors. As far as the law allows, we aren't liable for any indirect loss, or for decisions you make based on information on the site. Where the law lets us limit our liability, it's limited to resupplying the service or refunding the most recent amount you paid us.

Closing your account

You can delete your account at any time from your profile. We may suspend or close an account that breaks these terms. If we close a paid account for any other reason, we'll refund the unused part of the current billing period.

Changes to these terms

We may update these terms from time to time, and the date at the top will change when we do. If a change significantly affects you, we'll let account holders know by email before it takes effect.

Law

These terms are governed by the law of Western Australia, Australia.
